1. Who we are and acceptance

IWasKidnapped.com ("the App") is operated by FIBER LLC, a limited liability company organised in the State of Texas, United States ("we", "us"). You can reach us at Support@IWasKidnapped.com, or by post at our mailing address:

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App. The App is offered in the countries where it is listed on the app stores from which you download it; it is not offered in countries or territories where we do not distribute it or where the law prohibits it (see section 14).

2. What the App does

The App lets you set up a personal emergency alert. When you trigger an alert, the App sends the files, audio, photos, and location you have configured to the emergency contacts you have chosen.

The App is not an emergency service. It does not contact police, fire, ambulance, or any government responder. In an emergency, call 911. We do not guarantee that an alert will be delivered, received, or acted upon.

3. Eligibility

You must be at least 18 years old to use the App. You are responsible for keeping your password and PINs confidential.

4. Your responsibilities

• Provide accurate emergency-contact information and keep it current.
• Use the App lawfully and only for genuine personal-safety purposes.
• You are responsible for the consequences of triggering alerts, including false alarms sent to your contacts.

5. Recording of third parties

The panic features can record a short audio clip and photos and capture your location, and send them to your chosen emergency contacts. Some U.S. states require the consent of all parties to a conversation before audio recording — currently California, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, Washington, and Connecticut.

Outside the United States, comparable or stricter rules apply. Many countries make it a criminal offence to record a private conversation without the consent of every participant, and several also restrict photographing or filming other people. Most of those legal systems recognise a necessity or self-defence justification that covers recording evidence of a crime against you or a threat to your life. The panic features are provided for those genuine emergencies only, and you remain responsible for the law that applies where you are.

Most of these states provide a safety / crime-evidence exception that permits recording during a violent crime or to gather evidence of a crime against you — for example, kidnapping, extortion, or a threat to your personal safety (e.g., California Penal Code §633.5). The panic-recording feature is intended solely for such genuine emergencies.

By using the panic-recording features, you agree that:

1. You will use them only in a genuine emergency or threat to your personal safety, where recording is permitted under applicable law (including the exceptions above), and not to record others in ordinary circumstances.
2. You are solely responsible for compliance with the recording laws that apply to you, and — to the extent reasonable and safe — you will notify people around you that activity may be recorded when you set up the panic features.
3. IWasKidnapped.com and its operators are not liable for any claim arising from your use of the recording features in violation of applicable law.

This clause does not waive any safety or crime-evidence protections available to you under the law.

6. Subscriptions (Pro)

Some features (e.g. configurable dead-man-switch periods) require a paid subscription. Prices, billing, and renewal are handled by the app store (Google Play / Apple). Manage or cancel through your store account.

7. Acceptable use

You may not:

• Use the App to harass, stalk, or harm others.
• Reverse-engineer, attack, or disrupt the service.
• Upload illegal content.

We may suspend or terminate accounts that violate these Terms.

8. Disclaimers

The App is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, timely delivery of alerts, or that the App will prevent harm. Delivery depends on network, device, battery, OS permissions, and third-party systems outside our control.

9. Limitation of liability

To the maximum extent permitted by law, IWasKidnapped.com and its operators are not liable for indirect, incidental, or consequential damages, or for any failure or delay in delivering an alert. Our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the App, including claims related to recording or notifying third parties.

11. Changes

We may update these Terms. Continued use after changes means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-laws rules, and disputes will be brought in the courts located in Texas — except where applicable law gives you the right to bring a claim elsewhere.

If you live outside the United States, this does not take away your local rights. Where the consumer protection law of your country of residence gives you mandatory rights or a mandatory forum that cannot be excluded by agreement, those rights and that forum apply to you and nothing in these Terms limits them.

13. Language

These Terms may be published in several languages for your convenience. The English version is the controlling version; if a translation differs from it, the English text prevails, except where the law of your country requires otherwise.

14. Export controls and sanctions

We are a United States company and must comply with U.S. export-control and economic-sanctions law. You may not use the App, and we do not offer it, in a country or territory that is subject to comprehensive U.S. sanctions — currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk and Luhansk regions of Ukraine.

By using the App you confirm that you are not located in one of those territories, that you are not on a U.S. government restricted-party list, and that you will not use the App on behalf of anyone who is. Country availability in the app stores is set at country level; the territorial restriction above applies regardless of the fact that the surrounding country may be available.
