1. Acceptance

By creating an account or using IWasKidnapped.com ("the App"), you agree to these Terms. If you do not agree, do not use the App. The App is offered to users in the United States.

2. What the App does

The App lets you set up a personal emergency alert. When you trigger an alert, the App sends the files, audio, photos, and location you have configured to the emergency contacts you have chosen.

The App is not an emergency service. It does not contact police, fire, ambulance, or any government responder. In an emergency, call 911. We do not guarantee that an alert will be delivered, received, or acted upon.

3. Eligibility

You must be at least 18 years old to use the App. You are responsible for keeping your password and PINs confidential.

5. Recording of third parties

The panic features can record a short audio clip and photos and capture your location, and send them to your chosen emergency contacts. Some U.S. states require the consent of all parties to a conversation before audio recording — currently California, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, Washington, and Connecticut.

Most of these states provide a safety / crime-evidence exception that permits recording during a violent crime or to gather evidence of a crime against you — for example, kidnapping, extortion, or a threat to your personal safety (e.g., California Penal Code §633.5). The panic-recording feature is intended solely for such genuine emergencies.

By using the panic-recording features, you agree that:

  1. You will use them only in a genuine emergency or threat to your personal safety, where recording is permitted under applicable law (including the exceptions above), and not to record others in ordinary circumstances.
  2. You are solely responsible for compliance with the recording laws that apply to you, and — to the extent reasonable and safe — you will notify people around you that activity may be recorded when you set up the panic features.
  3. IWasKidnapped.com and its operators are not liable for any claim arising from your use of the recording features in violation of applicable law.

This clause does not waive any safety or crime-evidence protections available to you under the law.

6. Subscriptions (Pro)

Some features (e.g. configurable dead-man-switch periods) require a paid subscription. Prices, billing, and renewal are handled by the app store (Google Play / Apple). Manage or cancel through your store account.

8. Disclaimers

The App is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, timely delivery of alerts, or that the App will prevent harm. Delivery depends on network, device, battery, OS permissions, and third-party systems outside our control.

9. Limitation of liability

To the maximum extent permitted by law, IWasKidnapped.com and its operators are not liable for indirect, incidental, or consequential damages, or for any failure or delay in delivering an alert. Our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the App, including claims related to recording or notifying third parties.

11. Changes

We may update these Terms. Continued use after changes means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the United States and of the U.S. state in which the operator is established, without regard to conflict-of-laws rules. You agree that disputes will be brought in the courts located there, except where applicable law gives you the right to bring a claim elsewhere.
